The reality of the current economic situation is that the majority of Americans are one disaster away from being bankrupt. This means that many people are living from paycheck to paycheck and have a little money saved for a rainy day or even a minor emergency. This is not just a problem for people in the low-income range, but a major issue for those in the middle class as well. This has led to the fact that millions of people in the United States have bad credit.
If you fall into that category it is important for you to know your rights. According to federal law, consumers are not allowed to be hassled by creditors and collection agents. By definition, debt collection harassment is “intimidating, abusing, coercing, bullying, or browbeating consumers into paying off debt.” Typically speaking, this occurs most frequently over the phone, however debt harassment can also happen through emails, direct mail, texts, and even talking to your family, friends, and neighbors about your debt.
Collection agents are usually the main culprits. Collection agencies are allowed to attempt to recover the money that you owe to your creditors. That being stated, they are not allowed to use threatening or deceptive techniques when performing their job. Just because you have less than perfect credit does not mean that you deserve to be hassled.
How You Can Stop Collection Phone Calls
Typically speaking, collection agents will attempt to contact you by phone before utilizing other methods. In fact, collection agencies are infamous for violating the rules and regulations that are set forth to protect consumers from constant and hostile phone calls. Once you have heard from a collection agency the first time, there are a few steps that you can take in order to stop them from calling again. After the initial call, collection agents must adhere to strict limitations that are meant to protect your privacy.
For example, collection agents cannot call you at work. Perhaps the most important aspect is the fact that if a consumer does not wish to be called by a collection agent, the consumer can work with an attorney. At that point all phone calls from the collection agency must go through that attorney. You can also submit a cease-and-desist letter to the collection agency informing them that they can no longer contact you. The letter must be sent through certified mail.
