The bottom line is that many debt collectors continue to use illegal tactics because they know that the vast majority of consumers simply don’t know that it is against the law. Even if you didn’t know that fact, debt collectors are not allowed to contact you by phone, email, or text message multiple times per day.

Furthermore, they are only allowed to contact you between certain hours. They are also not allowed to stuff your mailbox with endless letters. Some debt collectors will contact your family, friends, neighbors, and even your boss if they can’t reach you directly. This is another huge violation. They are not allowed to do this. The Fair Debt Collection Practices Act (FDCPA) says debt collectors can’t harass, oppress, or abuse you or anyone else they contact. Some debt collectors are so deceitful that will make threats of violence or harm. They may also inform you that they are publishing a list of people who refuse to pay their debts in the local newspaper and on social media channels. In addition, debt collectors can’t call you without telling you exactly who they are. The FDCPA also states that debt collectors can’t use false, deceptive, or misleading practices, or make misrepresentations about the debt, including the amount of money you owe, or that they are an attorney if they are not.

Debt collectors simply cannot make false threats to have you arrested, or make threats to things that can’t be legally done. It is always a smart idea to keep a file of all letters or documents that a debt collector sends you, and copies of anything you send to a debt collector. In addition, write down dates and times of conversations along with notes about what you discussed. These records may very well help you if you have a dispute with a debt collector, meet with a lawyer, or go to court.
