Debt Collector Cannot Treat You Poorly If You Owe Them Money

The economy isn’t doing so great right now thanks to the current pandemic. That’s why a great deal of hard working American citizens are struggling to pay their bills. Some people are so behind that the original creditor has sent the account to a collection agency. If you have lost your job or had your hours significantly cut down, this may be happening to you. First and foremost, according to the Fair Debt Collection Practices Act, debt collection agencies are not allowed to contact you at all hours of the day or evening. In fact, they can only call you between the hours of 8 am and 9 pm. If they call you at home at any other time they are in violation of the law. Debt collection agencies are also not allowed to provide anyone but your lawyer or your spouse with information about your debt. However, a great deal of dishonest debt collection agencies will attempt to flush out debtors by contacting your neighbors, family, and friends. They may even resort to calling your employer.

The bottom line is that do this because they believe that if they embarrass you enough you will pay them. Speaking of embarrassing you, devious debt collection agencies will threaten to publish your name on a list of people that fail to pay their bills. The good news is this is also an illegal activity. Debt collection agents absolutely can’t do that. Last but certainly not least, the worst of the worst debt collection agencies will threaten to have you arrested if you don’t pay them. They can’t have you arrested unless they sue you in a court of law and you fail to show up to the hearing. At that point, the judge can issue a warrant for your arrest.
