Comenity Bank May Be Calling You

Do you have a Wayfair credit card and are behind on the payments? Maybe you have another store brand credit card and have a past due balance? If so, chances are that you are being contacted on a regular basis by Comenity Bank’s in-house collections and billing departments. This is due to the fact that Comenity Bank issues a great deal of those store brand credit cards to the tune of over 50 million customers nationwide. The bottom line is that when you are using a Pottery Barn or Restoration Hardware store credit card, you’re actually using a Comenity Bank credit card.

If you are late on your monthly payments and have a past due balance, Comenity Bank’s in-house collections and billing departments have a right to contact you in an attempt to collect upon the debt that you owe them. That being stated, they are supposed must do this in a specific manner that does not infringe upon your consumer rights. For example, under federal law, debt collectors are not allowed to use robo calls or automated dialing machines to contact you on your home phone or cell phone unless you have given them prior permission to do so.

In addition, debt collectors are not allowed to leave messages on either your home phone voicemail or cell phone voicemail unless you have given them prior permission to do so. However, not all debt collectors fully abide by the law. In fact, a few of Comenity Bank’s in-house collections department and billing department employees have not been properly following the law because they are utilizing robo calls and automated dialers. There are other actions that some debt collectors take that fall under the category of debt collection harassment, which is also known as debt harassment. Debt collectors are not allowed to make any unwarranted threats to consumers in order to attempt to collect a debt. For example, debt collectors have absolutely zero power to arrest you and cannot threaten to either arrest you or have you arrested for failing to pay the debt that is owed to them.

The only situation where you can be arrested for anything related to owing a debt is if the debt collectors sues you in a court of law and you fail to appear to the hearing at the appointed place, day, and time. Even in that situation, the debt collector is not the one that can have you arrested. The court itself is the only party that can issue an arrest warrant. If you receive a notice in the mail that you are being sued by a debt collector you need to appear in court. Debt collectors may also threaten to garnish your wages if you fail to pay them.

They do not have the power to garnish your wages, and are not allowed by federal law to threaten to do so.  In addition, debt collectors are not allowed to threaten to call or contact your family, friends, neighbors, co-workers, or your boss in order to discuss your financial situation. Last but certainly not least, debt collectors cannot threaten you with physical harm in any way, shape, or form. They only make these threats in order to scare you into paying the debt. The good news is that you have consumer rights and can stop this activity immediately.
