The reason that you are hearing from Comenity Bank instead of Victoria’s Secret is due to the fact that Comenity Bank is actually the issuer of the credit card. In essence, they are completely in charge of it. In fact, Comenity Bank handles the store credit cards for many retail chains and outlets across the country. They are actually one of the largest credit card companies in the United States. You may have also read about Comenity Bank or have seen them in the news recently because they are involved in multiple lawsuits that pertain to debt collection harassment.
Although Comenity Bank has the right to attempt to collect any debts that are owed to them by their customers; they have a legal responsibility to go about it in the proper manner from a legal standpoint. That means they are required to follow all of the rules and regulations that have been set forth by the Telephone Consumer Protection Act, or TCPA for short, when contacting customers about a past due debt. So what does the TCPA require? First and foremost, debt collectors, including banks, cannot contact debtors through the use of automated dialing systems without your permission.
They cannot make robocalls without your permission. In addition, they cannot leave messages without your permission. They cannot do these things when calling you on your landline or calling you on your cell phone. So why does some employees of Comenity Bank’s in-house collections and billing departments continue to do so even though it is technically not allowed? The answer is based on the reason that they are being paid to collect the debt that is owed to the company. Some debt collectors will do anything in order to accomplish that, even if they are not supposed to.
Some debt collectors know that most people do not know their consumer rights and take complete advantage of that. Some debt collectors are dishonest. Not all debt collectors are dishonest, but the ones that tend to make the most noise are the ones that also tend to bend the rules, or even break the law. If you feel as if you are being harassed, or that any party that is attempting to collect a debt that you owe is breaking the rules, there is something you can do about it. Contact us immediately. We are here to not only advise you, but to help you take action.
For example, did you know that under the TCPA, if a debt collector is using robo calls and or an automated dialing system to contact you without your permission, they might have to pay you a penalty of up to $500 per incident? Most consumers are completely unaware of this. We are here not only to inform you about your consumer rights, but to protect your consumer rights as well. The bottom line is that you no longer need to be a victim of debt collection harassment in any manner. We are sympathetic to your situation even if the debt collector is not.
We know that even the most hard working people can get down on their luck from time to time for a whole host of reasons. Maybe you lost your job due to the current economic downturn, or are spending your money helping to take care of a sick loved one? Just because you owe a debt certainly does not means that you should be harassed.
