Stop and Frisk: Massachusetts

A stop and frisk occurs when a police officer temporarily detains a pedestrian and pats down their outer clothing when there are specific and articulable facts leading a reasonable police officer to believe that the person is engaged in criminal activity and is armed and dangerous.

If you are stopped and frisked by a law enforcement officer, it is important to know your rights. If the officer detains you with no suspicion of illegality, you are free to leave. If the officer detains you based on speculation or a hunch of illegality, you are free to go. If the officer detains you based on a reasonable suspicion of illegality, ask if you are being detained. If yes, you are not free to go. If the officer detains you and conducts a “pat down” of your clothing for a dangerous weapon, ask if you are being detained. If yes, you are not free to go. If the officer has probable cause, enough information to believe a crime has been committed, he can place you under arrest.
