Sexual Assault is governed under Massachusetts General Law Chapter 265 Section 13 et seq. and is defined as “any crime in which the offender subjects the victim to sexual touching that is unwanted or offensive. The unwanted sex act is one that is forced upon someone, whether it is penetration or simply sexualized touching.”

There are two categories of sexual assault; indecent assault and battery and aggravated sexual assault; the difference being, if during the commission of the sexual assault, the victim suffers physical injury, the assault is elevated to an aggravated sexual assault crime. Sexual assault crimes carry liability that includes jail time and registration with the Massachusetts Sex Registry Board. Penalties are more severe if the victim is under the age of 14 years old, elderly, or disabled.
