Worried about your SSDI entitlements getting reversed? Connect with a SSDI Attorney

Most people seeking SSDI (Social Security Disability Insurance) think that an approved application marks the end of the road. However, it may not be the case for some.

Did you know that SSA (Social Security Administration) can revoke your entitlements?

Continued Disability Review

SSA (government agency) does periodic reviews of the approved cases. This review is called Continuing Disability Review (CDR).  SSA conducts these every few years depending on the particulars of your case. Aspects that might affect the frequency are:

  • Is your disability improving? If there are signs of improvement in your disability then you may have a CDR every year.
  • Is it a permanent disability? If it is a permanent disability then the CDR happens every seven years.
  • Your disability might improve but is not likely. If you are in this situation then your CDR will happen once every three years.

Factors that might revoke your SSDI

If you fear that your SSDI benefits might get revoked then speak with a SSDI lawyer/attorney. They know all about SSDI cases, and know how best to represent your case. In the meanwhile, here is a quick list of factors that might influence it:

  • Employment

You can earn up to $720 each month while you are on social security disability. If you earn more than $1000 a month then you run the risk of revoking your entitlement. And if SSA decides that your condition has improved and you are able to return to work then your SSDI might be revoked.

  • Incarceration

If you get incarcerated for more than 30 days in a prison for a felony or misdemeanors, your SSI benefits will stop. Your benefits can be reversed temporarily or permanently depending on the crime. However, by providing proof of release to the SSA, these benefits may be reinstated up on release.

  • Fraudulent Application

Your benefits would be stopped immediately if the SSA finds out that you have given false information, and that you are claiming benefits fraudulently. You will also face criminal charges.

  • Retirement

Your SSD benefits will automatically transfer over to retirement benefits if you reach your retirement age. The benefit amount does not change as the full retirement benefit is equal to your SSDI benefit amount.

  • Death

Death will result in termination of your SSDI benefits

  • Change in assets

If the SSA determines that you have an increase in your assets (buying new real estate) then you may lose your SSDI benefit.
