First and foremost, any company that you owe money to is allowed to attempt to collect that money. That being stated, there are rules and guidelines that debt collectors must abide by. For example, debt collectors are not allowed to contact you if you instruct them not to contact you.
That certainly does not mean that the debt magically disappears, it just means after you instruct them to stop contacting you they can no longer do so. They cannot have you arrested for not paying off your debt. They cannot garnish your wages for not paying off your debt. They cannot cause you any physical or emotional harm whatsoever for not paying off your debt. Once again, they can only sue you in a court of law, where a judge may or may not rule in their favor. By the way, the only way you can be arrested for having a past due debt is if the debt collector sues you in a court of law, and you fail to appear in court at the appointed day and time. At that point the court may very well issue a warrant for your arrest.
Unless you give them permission, a debt collector cannot use an automated dialing machine or make robo calls to your home phone or your cell phone. If they do, it is considered to be a form of debt harassment. Although most consumers are unaware of this, you may actually be entitled to receive upwards of $500 each and every time that this occurs. At times, Comenity Bank’s in-house collections and billing departments are dropping the ball in this regard.
That means they may very well be using automated dialing machines and robo calls when contacting you. This holds especially true if you are receiving calls from more than one of the following phone numbers.
