Advice For Dealing With Debt Collectors

When dealing with debt collectors it is always a smart idea to practice the three (3) C’s. That means you need to stay calm, cool, and collected. Keep in mind that debt collectors, especially collections agents may be working on commission. The bottom line is that the more they can get out of your pocket, the more they can line their own pocket. When you speak with creditors on the phone, do not act rude. Although it may be difficult, always keep an even demeanor. You should take in what they are telling you, but do not make any promises, especially promises that you can’t keep.

It is always better to speak the truth. Never try to intimate them. That is simply a game that you won’t win. Always keep accurate records. Typically speaking, most debt collectors use the telephone and mail when contacting debtors. However, they are starting to use email and text messaging. It is easy to keep records when they send you information through the mail. Simply save the documents in a file. The same hold true for emails and text messages. Make sure that you save them too.

It’s a bit more difficult to keep records of phone calls, but you should always get the debt collector’s name, phone number, and the company that they work for. Take good notes during the conversation. Keep in mind that they are most likely recording the call; so be as accurate in your notes as possible. The notes will come in extremely handy if you end up making a complaint or file a lawsuit against the collection agency at some point down the road. Speaking if which, a great deal of collection agents take part in a practice called debt harassment.

Although it is completely illegal, they do it because it is effective. In essence, the collection company will use scare tactics that go well above and beyond not only what they are allowed to, but also what is considered being a decent human. For example, debt collectors are not allowed to insult you in any manner. They are not allowed to swear at you or make you feel like you are less of a person simply because you owe a debt. Debt collectors are not allowed to threaten you in any way.
