That’s because some debt collectors have been using illegal tactics for so long that most consumers think it is normal.

Debt harassment is anything but normal, and needs to be stopped immediately. Once again, we are here to help. At this point you may be curious what the federal government considers to be debt harassment. The bottom line is that debt collectors must treat you appropriately whenever they contact you. That means they cannot yell at you, use swear words, or even say anything out of the ordinary that makes you feel uncomfortable. They are only allowed to communicate with you in a proper business manner including their attitude towards you and the tone in which they speak.

The fact of the matter is that debt collectors tend to be aggressive by nature, and it can come across in ways that actually violate your consumer rights that were put into place by the federal government in order to protect you. For example, if a debt collector acts too aggressively towards you they may be committing debt harassment, which is against the law. Of course some debt collectors are more aggressive then others. Some debt collectors will resort to calling you at times they are not supposed to. For example, if a debt collector calls you before 8 AM in the morning and or after 9 PM at night, they are violating your consumer rights.

The law clearly states that debt collectors can only call you between the hours of 8 AM and 9 PM. Some debt collectors will resort to threatening you in order to attempt to collect the debt. For example, the debt collector may call you up and tell you that they are about to have you arrested, and the only way to stop it is to pay them. Of course that can sound incredibly scary to the point that people pay them with their rent money or grocery money in order to avoid being arrested. The truth of the matter is that debt collectors cannot, we repeat cannot have you arrested for failing to pay your debt.

They don’t have the authority in which to do so. Under the consumer protection laws, if a debt collectors threatens to have you arrested he or she is committing debt harassment. At that point the debt collector is in the wrong. There are other threats that debt collectors are know to make to consumers in order to attempt to collect a debt. For example, the debt collector may threaten to have your wages garnished or have your unemployment check held back until you pay off the debt. Once again, debt collectors have zero authority to do this and are just telling you lies in order to scare you into paying them.

Sometimes debt collectors will get even more extreme with their threats. For example, a debt collector may tell you that they will have your children taken away. Once again, debt collectors have no authority to do this. They are flat out lying in order to scare you into paying them. As if these threats are not bad enough, some debt collectors will threaten to hurt you in a physical way just like a loan shark does to people who owe them money.
