Is Comenity Bank’s in-house collections and billing departments calling you on a frequent basis in order to collect a debt that you owe them? If you answered yes to this incredibly important question than you may very well be entitled to either join a class action lawsuit, or file a lawsuit of your own. Either way, we can help. However, we must clarify a few things first. First and foremost, you may be a victim of debt collection harassment or debt harassment for short. There is a fine line between what is right and what is wrong with the way debt collectors conduct their business.
For example, debt collectors are allowed to attempt to collect any debt that you owe them by contacting you on your home phone, cell phone, or by other electronic means of communication such as emails and social media. That being stated, debt collectors are not allowed to abuse their rights to collect a debt, yet some do. For example, if you are receiving phone calls at all hours of the day and evening, that is considered to be debt harassment. If the debt collector insults you, or makes threats than they are committing debt harassment.
Some debt collectors will stoop as low as to threaten your well being. Others will lie and tell you that they are either going to arrest you or have you arrested unless you pay them the money that is owed right away. By the way, debt collectors do not have the power to arrest you, or the power to have you arrested. Some debt collectors will make empty threats to call your boss in order to let him or her know that you are a deadbeat and should be fired from your job. Once again, they are not allowed by law to do this or threaten to do this.
Some debt collectors will threaten to call your family, friends, neighbors, and co-workers in order to tell them all about your debt in order to embarrass you. Once again, federal laws do not allow them to take this type of action or even threaten to take this type of action. Last but certainly not least, the law prohibits debt collectors from calling you with automated dialing machines and or robo calls unless they ask your permission and you allow them to do so. By the way, the law also prohibits telemarketers from this.
However, some employees of the Comenity Bank’s in-house collections and billing departments do use automated dialing machines and robo calls when attempting to collect a debt from you. Chances are incredibly high that you have not given them permission to do this. That means they are taking part in unfair debt collection practices, which is considered to be debt harassment. So what can you do if any of the above is happening to you? Principally speaking, you have consumer rights. When your consumer rights are violated you can sue the organization for damages.
The next question that you may be asking yourself at this point is how do you actually get the process started? The process starts by picking up your phone and contacting our office immediately. We will explain everything to you and answer all of your questions. We will then take the appropriate measures to ensure that you will not longer be harassed by anyone who is attempting to collect a debt from you. If your circumstances dictate that the best course of action is to file a lawsuit against the debt collector for debt harassment, we will guide you through the process from start to finish.
